Applicant: Comstock Homes
Location: North side of Holt Avenue, west of Grand Avenue
The applicant is requesting approval of a General Plan amendment changing the land use designation from "Planned Development" to "Low Medium Residential" (4.1 to 8.0 Dwelling Units per Acre), and a zone change from "Specific Plan No. 3" to "Specific Plan No. 17." The applications are necessary to facilitate the development of the 9.1-acre vacant site with a 46-unit, single-family residential subdivision.

3) Miscellaneous - Award of Bid
a) Uninterrupted Power Supply for Traffic Signals-Project TP-03505
This project provides for the installation of uninterruptible power supplies (UPS) for sixty-four City-maintained traffic signals. The City has received a State of California Grant Reservation from the California Energy Commission to help accomplish this work. Due to Grant time constraints, this work must be completed by no later than June 30, 2003. It is recommended that the City Council take the following actions:
- Appropriate the amount of $80,000 from unappropriated General Fund Reserves to account number 110-320-3356-7800.
- Authorize participation in the California Energy Commission's Battery Backup Program for Light Emitting Diode Traffic Signals program and authorize the Public Works Director/City Engineer to secure up to $119,104 in that program's funds.
- After removing from the scope of work those intersections that do not qualify for matching State funding, accept the bid of US Traffic Corporation in the amount of $251,104.00 as submitted at the bid opening on June 11, 2002, and authorize the Public Works Director/City Engineer and City Clerk to execute an agreement with US Traffic Corporation of Santa Fe Springs, California, for the work to be done.
- Adopt the following resolution:

b) State Home Funds Application - 2002
The City Council shall consider authorizing the City Manager to submit an application to the Department of Housing and Community Development to participate in the Home Investment Partnerships Program in response to the Notice of Funding Availability. It is recommended that the City Council adopt the following resolution:

c) BKK Landfill Closure Plans Monthly Status Report
This is an updated report on the Status of Plans for BKK Landfill Closure and other related BKK matters. It is recommended that the City Council receive and file this report.

d) Biennial Review of the City's Conflict of Interest Code
The Political Reform Act requires the City Council to review the City's Conflict of Interest Code every two years and make any necessary changes by the end of the year. It is recommended that the City Council approve the 2002 amended Conflict of Interest Code.
Miscellaneous - Public Works
e) Sale of a City Property Located at 815 California Avenue
A sale agreement is required to sell a portion of a City owned property located behind the California parkette site to Suburban Water Systems. It is recommended that the City Council take the following actions:
- Approve the sale of a portion of the California Avenue property to Suburban Water Systems of $138,600.
- Approve the purchase of the Cortez property from Suburban Water Systems for $14,385.
- Authorize the Mayor and City Clerk to execute the Sales Agreement with Suburban Water Systems.
- Appropriate $32,000 from the sales proceeds to renovate the Maintenance Division warehouse to relocate City records.
f) Tentative Tract No. 53821 - Comstock Homes
Holt Avenue Reduction of Travel Way
Comstock Homes has requested a deviation from the master plan of streets to reduce the portion of a travel way of Holt Avenue contiguous to their property. It is recommended that the City Council approve the deviation and advise Comstock Homes to deposit an in-lieu fee of $125,000 with the City to be used for future improvements on Holt Avenue.
g) California Building Code and the California Fire Code Ordinance
The Public Works Department and the Fire Department are requesting that the City of West Covina introduce an ordinance for the adoption of the California Building Standards Code; the 2001 Editions of the California Building Code and the California Fire Code; and other various codes. The date of the Public Hearing will be October 1, 2002, and the effective date of the ordinance is November 1, 2002. It is recommended that the City Council take the following actions:
1. Introduce the following ordinance:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING CHAPTER 7, ARTICLES II, III, IV, V, VI, VII, IX, XIII, XV, XVI, CHAPTER 10, ARTICLE II OF THE MUNICIPAL CODE RELATING TO THE ADOPTION OF THE CALIFORNIA BUILDING STANDARDS CODE AND THE 2001 EDITIONS OF THE CALIFORNIA BUILDING CODE AND CALIFORNIA FIRE CODE, 1997 UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, 1997 UNIFORM HOUSING CODE, 2001 CALIFORNIA MECHANICAL CODE, 2001 CALIFORNIA PLUMBING CODE, 2000 UNIFORM SIGN CODE, 2000 UNIFORM SOLAR ENERGY CODE, AND THE 2001 EDITION OF THE CALIFORNIA ELECTRICAL CODE
2. Set October 1, 2002, as the date for a Public Hearing concerning the adoption of the California Building and Fire Codes cited above.
Miscellaneous - Police Department
h) On-Going West Covina Service Group Equipment Costs
Historically, the West Covina Service Group's equipment account was included in its operating budget. For the current fiscal year, this equipment was moved to the CIP budget. It was not approved. This leaves the WCSG without the ability to purchase equipment that it needs right now. This need can be easily addressed by authorizing an appropriation from available WCSG revenue, with no burden on the General Fund. It is recommended that the City Council authorize the appropriation of $100,000 in 375-320-2141-7160 from available West Covina Service Group revenue (the fund balance of Fund 375).
Miscellaneous - Community Services
i) Application for Recreational Trails Program (RTP)
Staff is requesting authorization to apply for grant funding from the Recreational Trails Program (non-motorized projects) via the attached Resolutions for the Big League Dreams Trail Project ($225,000) and Heritage Garden Project ($125,000). It is recommended that the City Council adopt the following resolutions:

j) Approval of Request to Serve Alcohol at a Wedding Reception at the Senior Center
The Macias family is requesting approval to serve champagne, beer and wine at their wedding reception, which will be held at the Senior Citizen's Center on October 19, 2002. It is recommended that the City Council authorize the Macias Family of West Covina to serve champagne, beer and wine at the wedding reception on October 19, 2002 at the West Covina Senior Center.
k) Applications for Habitat Conservation Fund Grant Program
Staff is requesting authorization to apply for the Habitat Conservation Fund Grant Program under the California Wildlife Protection Act of 1990 via the attached Resolutions. Based on the grant requirements, the City of West Covina is eligible to apply for funds for the Galster Nature Program ($25,000), Heritage Garden Project ($175,000), the Big League Dreams Project ($200,000). It is recommended that the City Council adopt the following resolutions:

1) Appointment of City Council Representatives to Contract Cities Association
As part of the Fiscal Year Adopted 2002-2003 budget, the City Council approved joining the Contract Cities Association. As a member of the Contract Cities Association, the City of West Covina is allowed to designate a delegate and an alternate to serve on the Contract Cities Board. The City Council is being asked to confirm the appointments by the Mayor to the Contract Cities Association Board. This matter was continued from the September 3, 2002, City Council meeting. It is recommended that the Mayor make appointments to the Contract Cities Association described in the staff report, subject to City Council confirmation.
