2) Claims Against the City of West Covina (deny & notify claimant)
a) Frank Estrada vs. City of West Covina
On May 6, 202, the City Clerk's Office received a claim for property damage in the amount of $3,370. Claimant is seeking to recover costs he incurred to replace the sewer lateral at his residence.
b) Jay J. Neal vs. City of West Covina
On July 30, 2002, the City Clerk's Office received a claim for property damage in the amount of $9,178.32. Claimant is seeking to recover costs to repair damage of his recreational vehicle.
c) Juan Higuera vs. City of West Covina
On April 1, 2002, the City Clerk's Office received a claim for personal injuries. The amount of claim had not been determined at time of presentation. Claimant is seeking monetary compensation for injury to his left wrist.
d) Phyllis Gardner vs. City of West Covina
On August 9, 2002, the City Clerk's Office received a claim for monetary loss in the amount of $235. Claimant is seeking to recover costs she incurred for the release of her impounded vehicle.
3) Award of Bids
a) Five-Year Extension of the Landscape Maintenance Contracts for Maintenance District Nos. 1, 2, and 4
This five-year contract extension provides for the maintenance of landscape, natural areas, hardscape and sprinkler systems in Maintenance District Nos. 1, 2, and 4, with a ten percent reduction in the contract amount. It is recommended that the City Council take the following actions:
- Waive the formal bidding process per Section 2-333 (I)(2) of the West Covina Municipal Code; and extend the existing contracts for an additional five-years with a ten percent decrease in the contract amount.
- Authorize the Public Works Director/City Engineer and City Clerk to execute an agreement with Azteca Landscape of Pomona.
b) Purchase of Ford Expedition for Fire Department Senior Volunteer Program Utilizing Grant Funding
The West Covina Fire Department has been approved for a grant under the Federal Emergency Management Agency "Assistance to Firefighters Grant Program" to purchase a senior volunteer vehicle for a community based Fire Prevention Program. It is recommended that the City Council:
- Award the bid of purchase to Villa Ford for a 2003 Ford Expedition, according to specifications in Bid 0702-A, purchase price $30,039.37.
- Transfer the fund from the general fund to Account No. 139-320-2182-7170 to purchase the senior volunteer vehicle.
c) Self-Contained Breathing Apparatus Purchase
The Fire Department is requesting approval to replace its outdated breathing apparatus with new ones. It is recommended that the City Council authorize the award of bid to Special T Fire Equipment.
d) Award of Bid for Lease/Purchase of Fire Engine
The Fire Department is requesting approval to replace one aged fire engine with a new engine. It is recommended that the City Council:
- Award the bid to Jay Bressler Fire and Rescue Apparatus Spartan-Saulsbury for the lease/purchase of one Spartan-Saulsbury fire engine according to specifications in Bid No. 2000-7; and
- Adopt the following resolution:
RESOLUTION NO. __________ - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA AUTHORIZING THE EXECUTION AND DELIVERY OF A MASTER LEASE AGREEMENT, EQUIPMENT SCHEDULE NO. 01, AN ESCROW AGREEMENT, AND RELATED INSTRUMENTS, AND DETERMINING OTHER MATTERS IN CONNECTION THEREWITH
4) Miscellaneous - Personnel Services
a) Name Change of Personnel Services to Human Resources
The Personnel Services Department seeks to change its name to better reflect current terminology used to describe the function by most organizations that highly value their employees. Staff recommends that the City Council approve eliminating the name "Personnel Services Department" and adopt the recommended title of "Human Resources Department" and approve the classification name changes of "Director of Personnel" to "Director of Human Resources" and Personnel Analyst" to "Human Resources Analyst."
b) Personnel Commission Change in Meeting Time
The Personnel Commission desires to change their meeting time from 7:30 pm to 6:30 p.m. It is recommended that the City Council approve the Personnel Commission's meeting time change from 7:30 p.m. to 6:30 p.m. and adopt the following resolution:

c) BKK Landfill Closure Plans Monthly Status Report
This is an updated report on the Status of Plans for BKK Landfill Closure and other related BKK matters. It is recommended that the City Council receive and file this report.
Miscellaneous - Police Department
d) OTS Seat Belt Compliance Grant
The Police Department recently obtained a competitive grant funds from the State Office of Traffic Safety (OTS) to participate in a statewide seatbelt enforcement campaign. It is recommended that the City Council:
1. Accept the OTS CSBCC grant and appropriate the $12,073 as follows:
- $9,192 into 198-320-2111-5113 for traffic enforcement overtime;
- $910 into 198-320-2111-5151 for overtime Workers' Comp benefit;
- $133 into 198-320-2111-5155 for overtime Medicare benefit;
- $1,838 into 198-320-2111-5157 for overtime retirement benefit.
e) New Grant to Fund Three Police Officers
The Police Department recently obtained a competitive grant from the federal Office of Community Oriented Policing Services (COPS) that will fund three new Police Officer positions for three years. The mandatory cash match will come from the State Supplemental Law Enforcement Services Fund (SLESF) grant, thus constituting no burden on the General Fund. This anticipated grant was approved in the FY 2002-03 adopted budget. It is recommended that the City Council:
1. Accept the COPS UHP grant for $225,000 over three years, and appropriate the first year as follows:
- $35,000 into 136-320-2110-5XXX
- $35,000 into 136-320-2111-5XXX
- $35,000 into 136-320-2112-5XXX
2. Appropriate the remaining 2001 SLESF grant of $151,557 to 155-320-2110-5XXXX from the fund balance, as part of the required cash match.
3. Accept and authorize appropriation the next SLESF grant (an estimated $216,706) into 155-320-2110-5XXX as the continued cash match.
Miscellaneous - Fire Department
f) Training Reimbursement Fund Agreement -
Palo Verde Community College District
This action allows the Fire Chief to enter into an agreement with Palo Verde Community College District that will provide for the recovery to the General Fund of required training activities. This will replace an agreement with the Rancho Santiago Community College District, which is no longer able to fund our existing training reimbursement agreement. The Palo Verde Community College District has offered to provide us the same funding that we had with Rancho Santiago. It is recommended that the City Council authorize the Fire Chief to enter into an agreement with Palo Verde Community College District for participation in this joint training program.
4) Miscellaneous - City Clerk's Office
g) Follow-Up to Biennial Review of the City's Conflict of Interest Code
The City's Conflict of Interest Code was before the City Council on September 17, 2002 for review. It was held over to answer whether or not the City Council could impose full disclosure requirements on City Commissioners. This report also addresses the issue of consultants who file Statements of Economic Interest. It is recommended that the City Council approve the City's Amended Conflict of Interest Code and remove the Community Services, Personnel, Senior Citizens, and Water Management/Environmental Quality Commissions from the List of Designated Positions.

1) AMENDMENT TO MEMORANDUM OF UNDERSTANDING
WEST COVINA FIREFIGHTERS' ASSOCIATION
The West Covina Firefighters' Association has requested an amendment to their current Memorandum of Understanding (MOU) as it relates to retiree health benefits. It is recommended that the City Council take the following actions:
1. Approve the amendment to Section 9, Retiree Health Benefit, of the current MOU, to provide up to $4000 per month to offset retire medical premiums, subject to verification of premium payment amount, for all retirees effective December 1, 2002;
2. Appropriate $23,100 to account no. 110-320-2550-5160.
