It is recommended that the City Council approve an Amendment to the Exclusive Negotiating Agreement with Dynamic Business Holdings, Inc. and extending the term of the agreement for a period of one hundred fifty days to allow Dynamic Business Holdings, Inc. time to resolve various project development issues in order to prepare a Lease and Development Agreement for City Council consideration.

1. It is recommended that the City Council authorize staff to execute the following Amendment #6 to the Athens Services Waste Collection Contract:
  1. Revise the Schedule of Rates to include a 4.67% Consumer Price Index (CPI) increase (Attachment A of the staff report),

  2. Deny 2.19 % Special Interim Fuel Rate Increase (policy question),

  3. Deny retroactive rate increase to July 1, 2006 (policy question),

  4. Revise the 50% citywide waste diversion guarantee definition which would reduce the percentage of waste diversion from 61% to no less than 50% (policy question),

  5. Establish Annual Clean-Up Saturday's requirements for manageable handling sizes (policy question),

  6. Authorize administrative approval of service rate increases, unless 1% greater written protest by property owners (policy question),

  7. Adjust the CPI period from May-April to March-February and rate review application submittal deadline to March 20 (policy question).

2. Alternatively, after full consideration of the numerous policy decisions involved with these contract changes, City Council may wish to consider other combinations from the list of alternatives.
